Trump Seeks Dismissal of Georgia Election Case, Cites Presidential Victory
On Wednesday, the President-elect made a formal request to a Georgia court to halt the criminal proceedings associated with his attempts to nullify his loss in the 2020 state election.
His legal representative submitted an appeal urging the court to declare its lack of jurisdiction. They petitioned for an immediate dismissal by the trial court in Atlanta of the charges against Trump.
The argument presented hinges on the assertion that following Trump's win in the 2024 election, Georgia courts should no longer oversee the case.
Echoing this strategy, a similar plea was issued in New York, where Trump's team requested dismissal of the charges related to hush money payments.
Georgia Court Proceedings and Legal Arguments
In the legal documents filed, it was claimed that a sitting President is shielded from both indictment and any criminal proceedings, standing in both state and federal realms, as per the U.S. Constitution.
Though the swearing-in is set for January 20th, the appeal court is being urged to assess its authority ahead of this date, according to the filings.
The result of this review, the filing states, should be a determination that neither the current court nor the trial court can proceed with criminal actions against Trump, arguing it's against constitutional provisions.
Before the election, these proceedings had already been paused pending Trump's appeal to remove the district attorney from the case due to alleged conflicts of interest.
Additionally, a note was made about Special Counsel Jack Smith's decision to drop two federal cases against Trump, a move linked to his electoral victory.
These federal cases were tied to actions Trump took following his 2020 electoral defeat and concerning sensitive documents retained post-presidency.
Ultimately, only two prosecutions remain active: one in Fulton County and another in Manhattan.
Trump was previously convicted in Manhattan for falsifying business records related to payments made to Stormy Daniels, which were executed to influence the 2016 presidential race.
